What are the costs related to a real estate purchaseSpain: What are the taxes when buying a second hand property in Spain

In Spain, the notary's responsibility is limited to ensuring that the deed of sale of the property is properly drafted, that the purchase price of the property is paid to the seller, and to certify the identity of the parties signing the deed of sale.

The acquisition costs of the property are between 8% and 15% of the value of the property.

We have :

1.the property transfer tax ("Impuesto de Transmisiones Patrimoniales" or ITP) in the Valencian Community, it is 10% of the sale price of the property. 11% on properties over 1,000,000 euros.

2) Notary fees. The notary does not have the same role in Spain as in French-speaking countries. He or she is simply a registrar: he or she simply draws up the deed of sale and the mortgage deed (escrituras de compraventa y del préstamo hipotecario), reads the main passages, checks your identity and certifies your signature. His fees vary from 300 € (for a purchase of 50.000 €) to 900 € (for a purchase of 1 million €). Count on approximately 0.1% of the purchase value of the property.

3) Registration fees for the Property Registry ("inscripción en el Registro de la Propiedad"). The cost varies from 300 € (for a purchase of 50.000 €) to 650 € (for a purchase of 1 million €).

4) The Real Estate Advisor or lawyer specialized in real estate law: the advice is mandatory for a French-speaking person in order to verify the real state of the property and the different documents related to the sale.

If you choose the lawyer option, his assistance will cost you approximately 1% of the purchase value of the property. If you choose the real estate consultant option, therefore Spain Home Luxury, in the fees which are 3% of the sale price plus VAT at 21%, are included the legal verifications made by a tax lawyer specialized in real estate law that you will have the pleasure to meet if we work hand in hand.
